1. Introduction

Welcome to MyRandWise ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the MyRandWise website, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Important: MyRandWise is a technology company that provides personal budgeting software and financial literacy educational content. We are not a Financial Services Provider (FSP), bank, insurer, investment adviser, or tax adviser. We do not provide financial advice, sell financial products, or hold client funds.

2. Eligibility

You must be at least 18 years old and resident in South Africa to use our Services. By using MyRandWise, you represent and warrant that you meet these requirements.

3. What We Provide

MyRandWise provides the following:

• Personal expense tracking and budgeting software
• Bank account aggregation via read-only third-party services
• Savings goal setting and progress monitoring
• Group savings tracking tools (e.g., stokvel management)
• General financial literacy educational content
• Spending reports and data visualisation

4. What We Do Not Provide (No Financial Advice)

MyRandWise does not provide financial advice. All content on our platform, including articles, tips, calculators, and notifications, is for educational and informational purposes only. It is not intended to be and does not constitute financial, investment, tax, or legal advice.

You acknowledge that:

• We are not licensed or registered as a Financial Services Provider with the South African Financial Sector Conduct Authority (FSCA);
• We are not obligated to assess whether any financial product or strategy is suitable for you;
• Any decisions you make regarding your finances, investments, savings, or spending are made solely at your own risk and based on your own judgment;
• You should consult a qualified, licensed financial adviser before making significant financial decisions.

5. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information;
• Maintain the security of your account credentials;
• Promptly notify us of any unauthorised access;
• Accept responsibility for all activity under your account.

6. Bank Integration & Data Access

MyRandWise uses Yodlee, a third-party service provider, to aggregate bank account data. By linking your bank account, you:

• Authorise read-only access to your transaction data;
• Acknowledge that we cannot and do not initiate transactions, transfers, or payments from your accounts;
• Understand that bank integration availability depends on Yodlee's supported institutions;
• Accept that occasional delays or errors in data aggregation may occur.

7. Subscription & Billing

Certain features require a paid subscription. By subscribing:

• You agree to pay all applicable fees as described at the time of purchase;
• Subscriptions automatically renew unless cancelled;
• You may cancel at any time via your account settings;
• No refunds are provided for partial billing periods unless required by law.

8. Intellectual Property

All content, software, designs, and materials provided through MyRandWise are owned by or licensed to us and are protected by South African and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

9. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose;
• Attempt to gain unauthorised access to our systems;
• Interfere with or disrupt the Services;
• Reverse engineer or decompile any part of our software;
• Upload malware, viruses, or harmful code;
• Use automated means to scrape or extract data without permission.

10. Limitation of Liability

To the maximum extent permitted by South African law:

• MyRandWise is provided "as is" and "as available" without warranties of any kind;
• We do not warrant that the Services will be uninterrupted, error-free, or secure;
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services;
• We are not responsible for any financial losses, missed savings goals, or adverse financial outcomes resulting from your use of our budgeting tools or educational content.

11. Indemnification

You agree to indemnify and hold harmless MyRandWise, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Services ceases immediately.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Services after changes constitutes acceptance.
